Terms of Service for 37 Days of Change

These Terms of Service ("Terms") govern your use of the 37 Days of Change app, website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or older if required by your local law) to use the Service. By using the Service, you represent that you meet these requirements.

2. Accounts and Sessions

You may use the app with:
- A guest session (anonymous account).
- A claimed account (email/password account).

If you create a claimed account, you agree to:
- Provide accurate information.
- Keep your login credentials secure.
- Be responsible for activity on your account.

You are responsible for maintaining access to the email account used for sign-in and verification.

We may require account verification or additional steps for certain features.

3. Health and Wellness Disclaimer

37 Days of Change is a community and habit-support tool. It is not medical, mental health, legal, financial, or addiction treatment advice. Always seek qualified professional care when needed.

4. Acceptable Use and Safety

You agree not to:
- Break laws or infringe others' rights.
- Harass, threaten, impersonate, or abuse other users.
- Post unlawful, hateful, sexually explicit, violent, or otherwise harmful content.
- Spam, scam, or manipulate referrals or invites.
- Attempt unauthorized access to accounts, systems, or data.
- Interfere with the Service, including spam, bots, scripts, or abusive automation.
- Use the Service in a way that harms users, the community, or platform integrity.
- Evade moderation actions, including blocks, suspensions, or removals.

We have zero tolerance for objectionable content or abusive behavior.

Users can report content and block users in-app. We review and act on valid safety reports within 24 hours, including removing offending content and ejecting users who violate these safety rules.

We may remove content, restrict features, suspend accounts, or terminate access if behavior violates these Terms or community safety expectations.

5. User Content

You retain ownership of content you submit (for example chat messages, profile content, and support requests).

You grant us a limited, non-exclusive license to host, store, display, reproduce, and process your content only as needed to:
- Operate and secure the Service.
- Maintain community features.
- Provide support.
- Enforce moderation and safety rules.
- Improve Service reliability and abuse prevention.

You are responsible for content you post and for ensuring you have rights to share it.

6. Community Moderation and Safety

To help keep the community safe, the Service includes moderation tools such as reporting, blocking, content removal, and account restrictions.

We may review and act on reports, suspected abuse, fraud, or safety issues. Moderation actions may include warning, content removal, feature restriction, temporary suspension, or account termination.

7. Referrals and Invite Codes

The Service may offer invite links and invite codes for referral credit. Referral credit may be denied, reversed, or adjusted if we detect abuse, fraud, self-referrals, manipulation, technical invalidity, or other violations of these Terms.

We may change referral rules, eligibility, or reward structure at any time.

8. Paid Features (Plus)

Some features may require payment (for example, Plus access).

Important Plus terms for the current app version:
- Plus is a one-time purchase per challenge cycle (not auto-renewing unless clearly stated in-app).
- Plus may also be earned through eligible invite/referral rewards where offered.
- Earned Plus and purchased Plus both apply per challenge cycle.
- Plus access ends at the end of the applicable challenge cycle unless otherwise stated in the app.

Purchases are processed by Apple App Store or Google Play, not directly by us.

Pricing, billing, refunds, and payment disputes are governed by the applicable app store's terms and policies. If you have a purchase issue, you can contact us through in-app support or by email and we will do our best to help with access and support questions.

We may change Plus features, eligibility rules, or pricing in future versions to the extent allowed by law and platform rules.

9. Privacy

Your use of the Service is also governed by our Privacy Policy:

10. Service Availability and Changes

We may modify, suspend, or discontinue parts of the Service at any time.

We do not guarantee uninterrupted availability, error-free operation, or that every feature will always remain available.

11. Termination and Deletion

You may stop using the Service at any time.

In-app deletion options:
- Claimed accounts: Settings > Account Security > Delete Account
- Guest sessions: Profile > Delete guest session

We may suspend or terminate access if you violate these Terms or if necessary for safety, legal compliance, or abuse prevention.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied.

13. Limitation of Liability

To the fullest extent permitted by law, 37 Days of Change and its operators are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or related to your use of the Service.

Where liability cannot be excluded, it is limited to the maximum extent allowed by applicable law.

14. Indemnity

You agree to indemnify and hold harmless 37 Days of Change and its operators from claims, liabilities, damages, losses, and expenses arising from your misuse of the Service, your content, or your violation of these Terms.

15. Governing Law and Disputes

These Terms are governed by applicable law in the United States, without regard to conflict-of-law principles, except where mandatory local law requires otherwise.

Any dispute must be brought in a court of competent jurisdiction in the United States, unless applicable law requires a different forum.

16. Changes to These Terms

We may update these Terms from time to time. If we do, we will update the "Last Updated" date above and provide additional notice where required by law.

Continued use of the Service after changes means you accept the updated Terms.
